Ethel Burnett ("Burnett"), asserting error in the denial of her application for social security disability insurance benefits under Title II of the Social Security Act ("the Act"), 42 U.S.C. SS 401-433, has appealed the District Courts order affirming the final decision of appellee, Commissioner of Social Security ("Commissioner"), to deny Burnetts claim for disability benefits. The District Court exercised jurisdiction under 42 U.S.C. S 405(g), and this Court has jurisdiction over Burnetts appeal pursuant to 28 U.S.C. S 1291. For the reasons set forth below, we vacate the District Courts order affirming the Commissioners decision and remand the case with instructions to return it to the Commissioner for further proceedings consistent with this opinion.
